Terms of Service

Welcome to Michael D. Milson - HypnoCoach, LLC. By accessing and using our services, you agree to comply with and be bound by the following terms and conditions of service. These terms apply to all coaching programs offered through our website and direct interactions, including Hypnotherapy, NLP, EFT, and related techniques, customized to meet individual client needs.

Services Provided

Our services include personalized coaching and therapeutic sessions delivered via Zoom video calls. Clients are expected to ensure a stable internet connection and a quiet, undisturbed environment during sessions. Sessions are conducted in English and require the client's active participation and engagement. Sessions may be ended early or cancelled at our discretion and for any reason, if we deem the requirements of the session are not being met, or active participation of the client is not happening.

Payment and Refund Policy

Payment: Full payment for coaching programs must be made upfront via credit/debit card processed through Stripe, our payment processor. Monthly payment plans are available for non-promotional purchases, and handled by an outside company.

Refunds: All payments are final. No refunds will be issued for any services purchased, including those bought during promotional periods.

Cancellation and Rescheduling

Clients may reschedule a session with at least 24 hours' notice. Rescheduling within 24 hours of a session or no-shows will be addressed on a case-by-case basis, and may result in the forfeiture of the session without a refund.

Repeated no-shows (more than three missed sessions within a two-month period) may result in the termination of the client's program without a refund.

Client Obligations

Clients are required to attend sessions on time and prepared. Failure to meet these conditions may lead to session cancellation or program termination at the discretion of Michael D. Milson - HypnoCoach, LLC.

Privacy Policy

We collect personal and contact information necessary to provide our services effectively. This information is stored securely and is not shared with third parties, except as required for functionality through third-party services like Facebook Pixel, Google Analytics, and HotJar, which are governed by their respective privacy policies.

Limitation of Liability

Clients are responsible for their own progress and outcomes. Michael D. Milson - HypnoCoach, LLC and its representatives are not liable for any personal, professional, physical, financial, or psychological consequences that may occur before, during, or after the use of our services. We do not provide medical, legal, or other professional advice.

Intellectual Property

All content provided during sessions, whether digital or otherwise, is the intellectual property of Michael D. Milson - HypnoCoach, LLC. Clients are prohibited from copying, sharing, or using this content outside of personal use without express written permission.

Modification of Terms

We reserve the right to modify these terms at any time. Your continued use of our services following any modifications signifies your acceptance of the new terms.

Governing Law

These terms are governed by the laws of the State of Michigan.

Dispute Resolution and Binding Arbitration Agreement

Internal Resolution: You and Michael D. Milson - HypnoCoach, LLC agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the services provided in connection with these terms directly through negotiation with good faith efforts. This process of negotiation will be initiated upon receipt of a written notice by either party to the other, detailing the nature of the dispute and any proposed resolutions. Both parties will have 30 days from the receipt of the dispute notice to address and resolve the dispute internally.

Mandatory Binding Arbitration: If the dispute cannot be resolved through internal negotiation, you agree that the exclusive means of resolving any dispute, claim, or controversy, of any amount or nature, shall be binding arbitration as detailed herein. This arbitration will be conducted by a single neutral arbitrator and held in the State of Michigan under the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and legally binding and judgment may be entered thereon.

No Other Legal Recourse: Both parties expressly waive any right to sue in court, including any right to a jury trial for disputes arising under these terms or associated with services you receive from us. This waiver applies to any action or legal proceeding of any kind that would otherwise be governed by these terms.

Limitation on Claims: No arbitration or other action will be combined with another without the prior written consent of all parties to all affected arbitrations or actions.
